SparkHabits LLC offers a mobile and web app platform designed to assist coaches in providing habit coaching at scale to their clients.
Subscription and Payment
A platform fee is applied to each transaction based on the terms signed up with the coaches. Coaches set their own rates for end clients, with subscriptions billed on a monthly basis. Payments are processed through Stripe.
User Account Management and Data Collection
- User accounts are managed through a central admin panel for coaches, with individual user access controls.
- We collect basic personal information, usage data, user preferences, and interaction data for service optimization.
- Biometric login options, such as FaceID or fingerprint unlock, are used for enhanced security.
Security & Privacy
- We use standard encryption protocols for data transmission, multi-factor authentication, and secure storage solutions with Google Firebase and Cloud Functions.
- Our codebase is encrypted/scrambled, and we have measures in place to prevent DDoS attacks.
- We have plans to achieve HIPAA and SOC 2 compliance.
Modifications to the Service and Prices
We reserve the right to update or modify our services periodically, with changes communicated through in-app notifications, emails, or website updates. Pricing adjustments may occur, with users notified in advance. Continued use of our service following changes constitutes acceptance of those changes.
User Conduct and Responsibilities
- Users must interact respectfully and avoid harassment, bullying, or abusive behavior.
- Content that is illegal, harmful, threatening, abusive, defamatory, obscene, or invasive of privacy is prohibited.
- The platform should be used for its intended purpose of habit coaching. Confidentiality is crucial, especially concerning information obtained during coaching sessions.
Intellectual Property Rights
All content on the platform is owned by SparkHabits LLC or its licensors. Users retain ownership of their generated content but grant us a license to use it for operational purposes. Users must respect third-party intellectual property rights and comply with copyright laws.
Disclaimer of Warranties and Limitation of Liability
The platform is provided "as is" without warranties. We limit our liability for indirect, incidental, special, consequential, or punitive damages.
Termination of Use
We reserve the right to terminate or suspend accounts at our discretion. Users can terminate their accounts through 'Program Group Settings Subscriptions. Upon termination, all rights and access to the platform cease at the end of the subscription period.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Dallas, Texas. Disputes are resolved first by contacting us, then through arbitration or small claims court, where applicable.
Refund and Cancellation Policy
Subscriptions can be canceled under 'Profile Settings' Subscriptions', with no refunds offered. Subscription changes take effect based on the type of adjustment (immediate for upgrades, end of the period for downgrades). Subscriptions renew automatically, with cancellation options available in the user profile settings.
